Introduction

These terms and conditions (the "Terms") apply to the hire of electric skateboards ("Skateboards") from Chillboarders Aotearoa ("we," "us," or "our") located in Gisborne, New Zealand. By hiring a Skateboard from us, you agree to be bound by these Terms. If you do not agree to these Terms, you may not hire a Skateboard from us.

Hire Period

The hire period for a Skateboard will commence on the date and at the time specified on the hire agreement and will continue until the Skateboard is returned to us in accordance with these Terms.

Hirer's Obligations

3.1 The hirer must:

• be at least 16 years old

• must show a valid form of ID that we can keep on record

• use the Skateboard in a safe and responsible manner, in accordance with all applicable laws and regulations;

• not modify or tamper with the Skateboard in any way;

• not carry passengers on the Skateboard;

• not use the Skateboard while under the influence of alcohol or drugs; and

• return the Skateboard to us in the same condition it was in at the time of hire, reasonable wear and tear excepted.

3.2 If the hirer fails to comply with their obligations under these Terms, we reserve the right to terminate the hire agreement immediately and recover the Skateboard.

Liability

4.1 The hirer is solely responsible for any loss or damage to the Skateboard while it is in their possession.

4.2 The hirer agrees to indemnify and hold us, and our affiliates, officers, agents, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of the hirer's use of the Skateboard, breach of these Terms, or violation of any rights of another.

4.3 We do not accept liability for any loss or damage to personal property left on or in the Skateboard.

4.4 We do not accept liability for any injury or damage caused to the hirer or any third party as a result of the hirer's use of the Skateboard. The hirer assumes all risk associated with the use of the Skateboard.

Return of Skateboard

5.1 The hirer must return the Skateboard to us at the end of the hire period in accordance with the instructions provided at the time of hire.

5.2 If the Skateboard is not returned to us by the end of the hire period, the hirer will be charged for each additional day the Skateboard is not returned.

Termination

We reserve the right to terminate the hire agreement at any time and recover the Skateboard if the hirer breaches these Terms or if the hirer uses the Skateboard in an unsafe or irresponsible manner.

Governing Law

These Terms and the hire agreement between the hirer and us shall be governed by and construed in accordance with the laws of New Zealand.
